Court Deems Obama-Era DACA Program Unlawful – Biden Invokes “MAGA Republicans” In Response

On Wednesday, a federal appeals court ruled the Obama-era Deferred Action for Childhood Arrivals (DACA) program was not legal.

According to the Wall Street Journal, while current members of the court of Appeals will allow current members of the program to remain, the Fifth Circuit Court of Appeals did all but shut down the program.

Former Vice President Biden criticized the decision stating it is “the extreme agenda being pushed by MAGA-Republican officials.” He went on to say, “I am disappointed in today’s Fifth Circuit decision holding that DACA is unlawful. The court’s stay provides a temporary reprieve for DACA recipients but one thing remains clear: the lives of Dreamers remain in limbo.”

The DACA program, created in 2012, was created to circumvent congressional approval, by allowing illegal immigrant children to remain in the US. It is estimated that 1.5 million migrants qualify for DACA. While 600,000 have already been approved.

DACA, according to the Fifth Circuit, has been found to be unlawful due to the absence of congressional approval. It also found the Executive branch was acting without the legal merit to take such actions.
